You will require Employers Liability if a person works for you or your business (for example if you supply their work materials, control where or how they work, or generally treat them like an employee).
An employee can be paid or work on a voluntary basis.
Company directors of a Limited Company are also defined as employees of the company. If you're the sole director of your limited company, own 50% or more of the shares, and have no employees, Employers' Liability Insurance isn't required.

Heat, Fire or Sparks
The use of heat is defined as any naked flames or sparks used within a performance.
Performances involving the use of non naked flame items such as toasters, glue guns, soldering irons, hairdryers, curling tongs etc are not deemed as heat work.

Public & Products Liability
Legal liability for damages and costs in respect of accidental injury to persons, accidental damage to property or accidental nuisance occurring in connection with the business of the insured and associated legal costs.
Products Libility:
Legal liability for damages and claimants' costs and expenses in respect of accidental injury or accidental damage to property caused by any product and associated legal costs.
Employers Liability
Legal liability for damages and claimants' costs in respect of any person employed arising out of and in the course of their employment, as well as legal costs incurred with the written consent of HCC International Insurance Company PLC.
You will require Employers Liability if someone works under your instruction and you have a right to control where and when they work and/or you supply the work materials/equipment.
An employee can be paid or work on a voluntary basis.

All Risk
Physical loss, destruction or damage to equipment, and trade materials.
Manual Labour
Any manual labour outside the normal 'turnaround', 'get-in' or 'bump-in' process of changing stage props etc.
Work involving the erection of show tents, marquees, staging, lighting, seating etc is considered manual labour..

Act Performed Above Audience
We will not provide indemnity in respect of any act performed directly above an audience.
Hairdressers and Beauticians Treatment
The Public and Products Liability sections of this Policy are extended to include the Insured's liability arising out of treatment given during the course of their activities as hairdressers and beauticians.
It is a condition precedent to any liability of the Insurers under this Endorsement that, on every occasion prior to the undertaking of any hair dyeing or other treatment, the Insured shall observe and apply all the tests and procedures required or recommended by the makers or vendors of such hair dyes or other treatment or cosmetics. If the result of any such test or procedure is unsatisfactory, the Insurers shall not be liable for any consequence whatsoever which may arise from the Insured proceeding with such hair dyeing or other treatment.
Liability is extended to indemnify the insured against liability at law for compensation in respect of injury or damage to property caused by or arising from the treatment rendered by the insured in the course of the business of beautician for the application of:
- Cosmetics
- Pedicures and manicures
- Facial masks including ionisation and steaming treatments
- Proprietary hair removal preparation
- Massage
- Application of spray tans, tanning creams and oils but excluding the use of sunbeds, solarium or other ultraviolet equipment
- Ear and Nose piercing using a stud gun
- Hair Treatment
Exclusions
This Endorsement excludes:
- any permanent waving, dyeing, tinting or bleaching treatment by any apprentice or learner with less than two years' experience unless such apprentice or learner is working under the direct and continuous supervision of a qualified operator;
- face lifting or plastic surgery or tinting of eyelashes;
- any preparation or other goods manufactured or made up to the formula of the Insured;
- electrolysis;
- hypnosis;
- tattooing;
- body piercing other than ear and nose piercing;
Bona Fide Sub Contractors Condition Hazardous Activities
It is a condition precedent to the liability of Insurers that the following activities shall be carried out by bona-fide sub-contractors:
- erection of stands stages or similar structures
- provisions of security crowd control or stewarding
- work above 3 metres from the ground or stage or floor level
- storage provision or use of fireworks or pyrotechnics
- provision of food or catering
- Hazardous Activities including but not limited to, fairground and amusement rides, bouncy castles, motorised activities, waterborne activities, aerial activities, fireworks, explosives or stunt work.
All bona-fide sub-contractors shall have in force their own Public Liability insurance for not less than GBP5,000,000 and extends to cover the event and any period prior to or after the event for the setting-up installation dismantling rehearsals and any other action required in connection thereto whilst on the Insureds premises and that the Insured shall establish that such insurance is in force by the bona-fide sub-contractors, or as otherwise agreed with Insurers
The Limit required above is to be no less than our own insured limit.
Clubs – Individual Liability to Members
Exclusion 6 under Public and Products Liability Sections of this Policy is deleted and cover is extended to include members and officials of the insured club whilst taking part in the activities of the club
Inflatable Structure Bouncy Castle
It is a condition precedent to the liability of Insurers that the following activities shall be carried out by bona-fide sub-contractors:
Hazardous Activities including but not limited to, fairground and amusement rides, bouncy castles, motorised activities, waterborne activities, aerial activities, fireworks, explosives or stunt work.
All bona-fide sub-contractors shall have in force their own Public Liability insurance for not less than GBP5,000,000 and extends to cover the event and any period prior to or after the event for the setting-up installation dismantling rehearsals and any other action required in connection thereto whilst on the Insureds premises or a site where they are undertaking work and that the Insured shall establish that such insurance is in force by the bona-fide sub-contractors, or as otherwise agreed with Insurers
The limit above is to be no less than our own insured limit
Heat Warranty
Public Liability and Products liability section exclusion 8 Heat away from insured's own premises is replaced by the following Heat Condition:
It is a condition precedent to the liability of Insurers that where heat work is declared by the Insured as an activity and permitted, as shown on the schedule, the insured must ensure that the following precautions are complied with on every occasion, where the application of or use of heat is involved
(i) Before the activity commences:
- If the activity is undertaken within the confines of a building the Insured and any Employees on each site must make themselves aware of the location of the sites fire alarm and fire fighting appliances.
- The Insured must examine all Property in the vicinity to ensure that no combustible material is in danger of ignition either directly or by conducted heat.
- An exclusion area of at least 2 metres from the display must be clearly designated to ensure that members of the public can see the area where the display is to take place.
(ii) During the activity:
- Care must be taken to ensure that any member of the public does not enter into the display area.
- If the gathered audience do encroach then the use of heat should cease immediately and not recommence until the exclusion area is clear and the insured has assessed whether a wider area should be defined.
- Suitable fire extinguishing appliances must be available on the scene.
(iii) After the activity ceases:
- Upon the completion of the work or performance and before leaving the site the Insured or Employee of the Insured shall undertake a thorough examination of the immediate vicinity of the work i.e. within a radius of 5 metres.
Participant to Participant Liability
This Policy does not provide indemnity in respect of Bodily Injury and/or Damage to Property caused by one participant to any other participant including any referee and/or their property.
Knife Throwing Endorsement
It is noted that no indemnity is afforded under the Public and Products Liability section of this Policy arising from knife or similar object being thrown at humans or animals.
Groups Bands and Orchestras Endorsement
- This policy excludes liability occurring as a result of a member of the insured band, group or orchestra practising or performing as a solo artist/performer, with bands or groups other than the insured band.
- The indemnity provided under this policy extends to include temporary increases in the number of people in groups, bands and orchestras. For the purposes of this policy temporary increases are defined as up to 20% of the declared number of people for a maximum of 10 days in total in any one period of insurance. Any increase in numbers beyond this must be notified to the company and any additional premium paid.
Film Video Production Endorsement
We will not provide indemnity in respect of Underwater or Aerial Filming.
Food Safety Act
The Company will indemnify the Insured for all Legal Costs and Solicitors' Fees incurred with the written consent of the Company in respect of the defence of a prosecution or in connection with an appeal against criminal prosecution and conviction in respect of a breach of Part II of the Food Safety Act 1990 or successors thereof that has occurred during the period of insurance in connection with the Business.
Provided that the Company shall not be liable for:
- the payment of fines or penalties:
- a breach that was as a result of an intentional or deliberate act.
The Directors Guild
This policy will cover the insured for their legal liability arising out of any of these activities for which they are legally responsible.
Please note:
Any activities which include the use of pyrotechnics, set building / striking or stunts are not covered within this scheme. Cover may still be arranged by calling the Performing Arts Team on 01686 626019.
The scheme does not cover for Libel and Slander.
